VACATION RENTAL AGREEMENT

RENTAL PERIOD

This lease shall commence on ___________after 3 pm (the "check-in" time) and shall terminate on ______________at 10 am (the "check-out" time). Failure to check out before 10:00 am will result in a charge equivalent to a full-day’s rate.

Reservation Deposit
Reservations are on a first-come, first-served basis. A deposit equivalent to 50% of total rental cost must be submitted before the desired rental period is secured. The balance of total rental payment must be received no later than 30 days prior to check-in date.
In the event the remaining balance is not received by the aforementioned date, the reservation may be canceled and the deposit may be forfeited unless provisions are made as per the Cancellation Clause in this rental agreement.

Refundable Damage Deposit
A damage deposit of $500 is required for possible property damage, excessive cleaning, missing property items, intentional, willful damage or gross negligence and any non-compliance of rental policies. Upon your departure, our team of maintenance personnel will carefully inspect the unit. If there are no damages or loss of property items, a full refund of the deposit will be issued within 30 days of departure. Please report all damages upon arrival or while occupying the property. Failure to do so will result in forfeit of the damage deposit.

OCCUPANCY

  • The said property has a maximum occupancy of 26 people and is limited to number of sleep spaces. Overcrowding and falsification will result in expulsion and loss of deposit. Large group parties are subject to prior approval from owners.

  • All occupants of the rental property must be listed in the rental agreement. Tenant shall serve as representative and shall be held accountable and responsible for all provisions of this agreement. Each occupant over 18 years of age is equally responsible for observing the terms and conditions specified in this rental agreement and for any damage.

  • Tenant shall be held fully responsible and accountable for any damages to said property caused by any tenants under the age of 18.

  • The Tenant’s signature certifies that Tenant is over 18 years of age, has read this agreement, and understands that breach of any terms can and will result in the loss of damage deposit plus any additional costs for repair.

  • Owner reserves the right to make unannounced inspections and changes to home furnishing and decor

CLEANING

The rental amount includes professional departure cleaning. However, Tenant(s) shall clean all dishes and cookware upon departure. Failure to clean dishes & cookware will result in an increase in cleaning departure fees which will be taken from the deposit.  Also please note Garbage Collection Schedule so as to properly dispose of waste. (Summer pick-up is 3 times/week).

LINENS AND SUPPLIES

Linens (sheets, pillowcases, towels, blankets) are NOT provided.   These must be furnished by Tenant or a Professional Linen Service (Vacation Equipment Rentals 1-800-213-2901 and many others). The service will deliver your linens to the property and pick them up upon your departure.  Personal toiletries, bathroom tissues, soap, and laundry detergent are NOT provided but may be purchased at local convenience stores. The home is equipped with iron/iron board, washer/dryer and vacuum.  The kitchen is well equipped, but you may want to bring your favorite pans.

CANCELLATIONS

Should the Tenant(s) need to cancel this rental agreement, a written notification is required. No refunds will be given if notice is given within 30 days of arrival. Refund will be given if notice is given before 30 days of arrival minus a $100 service fee.

In the event that the home is sold, the tenant will be given a full refund of all amounts paid for canceling the reservation or the reservation will be transferred to the new home owner with all agreements intact.

SEVERE WEATHER

If the State or Local authorities order a mandatory evacuation of an area that includes the property subject to this vacation rental, and the guests comply with the order, guest is entitled to a refund of the prorated rent for each night that the guest is unable to occupy the property because of the order. Guest must take all possessions upon evacuation, as re-entry cannot be guaranteed.

PETS AND SMOKING POLICY

This is a NON-SMOKING home and absolutely NO PETS are permitted. Should a pet or evidence of smoking be discovered during occupancy or immediately post-departure, the Tenant will be evicted from the rental property without refund and the damage deposit fully withheld.

OWNER LIABILITY

THE OWNERS OF SAID RENTAL PROPERTY ARE NOT RESPONSIBLE FOR ANY INJURY OR ACCIDENTS OCCURING ON THE PROPERTY OR FROM THE USE OF ANY WATERCRAFTS INCLUDED AS AMENITIES OF THE PROPERTY. THE OWNERS ARE NOT RESPONSIBLE FOR ANY LOST OR STOLEN PERSONAL ITEMS. ***THERE IS NO SUPERVISION AT CANAL, BOATING DOCK or PRIVATE PLAYGROUND. ALL TENANTS AND THEIR CHILDREN/DEPENDENTS SHALL USE AMENITIES AT THEIR RISKS.

***THIS IS A VACATION RENTAL UNDER THE NC VACATION RENTAL ACT. THE RIGHTS AND OBLIGATIONS OF THE PARTIES TO THE RENTAL ARE DEFINED BY LAW AND INCLUDE UNIQUE PROVISIONS PERMITTING THE DISBURSEMENT OF RENT PRIOR TO TENANCY AND EXPIDITED EVICTION OF TENANTS. YOUR SIGNATURE(S) ON THIS RENTAL, OR PAYMENT OF MONEY OR TAKING POSSESSION OF SAID PROPERTY AFTER RECEIPT OF RENTAL IS EVIDENCE OF YOUR ACCEPTANCE OF RENTAL AND YOUR INTENT TO USE SAID PROPERTY FOR A VACATION RENTAL.
